Terms of service

This is a translation. The Polish version of this document is binding and prevails in case of any discrepancy.

§ 1. General provisions

These terms set out the rules for using the website bevisible.social and for services provided under the BeVisible brand. The service provider is Andrii Sovietov, sole trader registered in Poland (jednoosobowa działalność gospodarcza), NIP 6762705765, REGON 543118126, address: ul. Szlak 77/222, 31-153 Kraków, Poland. Contact: [email protected], tel. +48 570 415 387.

§ 2. Services on the website

  • The website lets you send a request and fill in a brief. Both services are free.
  • To use the website you need a device with internet access and an up-to-date browser with JavaScript enabled.
  • Sending unlawful content through the website is prohibited.
  • You can stop using the website services at any time simply by no longer using them.

§ 3. Production and editing of Reels made to order

  • The provider produces and edits short videos (Reels) and prepares photo posts, carousels, post texts (captions) and hashtags to the client's individual order, from materials supplied by the client: photos, videos, voice recordings or a description. Whatever these terms say about Reels also applies to these other materials unless the context shows otherwise.
  • Each Reel is made individually: the provider prepares the script and the edit, and the client approves the Reel or asks for revisions, which the provider makes. Software tools, including AI-based ones, are used to assist production.
  • The result of the service is finished materials delivered to the client: video files, images, carousels and texts. The provider does not manage the client's social media accounts or run advertising campaigns.
  • At the client's request, the provider may deliver finished Reels to the client's post scheduling service (for example Publer or Buffer). The client creates the account in that service, and the client posts the Reels.
  • Details of cooperation, including platforms and how materials are sent, are agreed in messages or in a contract.
  • The provider also makes 3D animated films: Reels up to one minute with drawn characters invented for the client's business, who stay the same from episode to episode. The provider agrees the script of each episode with the client before production starts.
  • To order, the provider also makes landing pages based on the client's brief. Scope and timing are agreed in correspondence.
  • A Standard subscription starts with a free 7-day trial, during which the provider makes Reels on the same terms as in the paid period.
  • The trial is available once per client. If a client subscribes again (including with a different email address or a different card), the provider may end the trial, and the first payment will be charged immediately.
  • The trial lasts 7 days but covers no more than 21 video Reels (photo posts and carousels do not count), whichever comes first. When the 21st video Reel is delivered, the trial ends automatically: the first payment is charged the same day, and the first paid month starts on that day. After the 18th video Reel the provider reminds the client of this in a message. A client who does not want to continue may cancel the subscription before that and then pays nothing.

§ 4. Price and payment

  • The service is provided as a monthly subscription in one of the packages described on the Packages page: Mini 75 USD, Standard 150 USD, Standard Plus 200 USD, Maxi 300 USD, Giga 500 USD a month. The scope of a package is set by its description on that page on the payment date. The client's bank may charge the equivalent in the card currency at its own exchange rate.
  • The Mini package includes up to 8 Reels a month; in the other packages the number of Reels is not limited. 3D animated films and Reels with a digital double are included in Standard Plus, Maxi and Giga in the number given in the package description (one of the two is chosen per package). Beyond the package, including in Mini and Standard, an animated film costs 40 USD and a Reel with a digital double 30 USD; they are paid as a one-time order (§ 4a).
  • Prices on the website are final: the provider adds no VAT or other charges to them.
  • Payment by card (including Apple Pay and Google Pay) via Stripe on bevisible.social. For Standard, when subscribing, the client enters a card, but nothing is charged: the first payment is taken on day eight, after the trial ends (or earlier if the trial ends earlier, § 3), and the following ones automatically once a month until cancelled. Three days before the trial ends, Stripe sends the client a reminder. In the other packages the first payment is taken at checkout and the following ones automatically once a month.
  • A client who cancels during the trial pays nothing.
  • A client that is a company enters the company name and tax ID at checkout; an invoice for the company is sent by email after each payment. At the client's request, payment by bank transfer against an invoice, without a card, is also possible.
  • A subscription paid by card is cancelled by the client in the Stripe customer portal (link in the Stripe email and on the website); cancellation takes effect at the end of the trial or of the paid month.
  • Landing page: 300 USD once, paid in advance via Stripe. Domain and hosting are paid separately at the registrar's prices.

§ 4a. One-time orders with a balance

  • Besides a subscription, the client may place a one-time order. The provider prepares a payment page with the agreed order, and the amount paid goes to the client's balance. The payment link is valid for 14 days.
  • Prices: Reel 10 USD, Reel with a digital double 30 USD, 3D animated film up to one minute 40 USD, carousel 5 USD, photo post 1 USD. The provider deducts the price of an item from the balance when the finished item is delivered to the client.
  • Revisions the client asks for in ordinary correspondence are free. An item made again from scratch (a new topic or a new script) is charged as new. Remaking an item because of the provider's error is free. The price of an animated film covers all the generations it needs.
  • The order can be changed along the way as long as the balance covers it. After each delivered item the provider tells the client the remaining balance. When the balance runs out, the provider finishes the item already in progress and starts new ones after a top-up.
  • Each top-up is valid for 6 months from the payment date. Funds are taken first from the top-up that expires earliest. The provider sends a reminder 2 weeks before a top-up expires; funds not used in time expire.
  • Funds paid are not refundable, without prejudice to the rights of the clients referred to in § 10. An invoice for the full amount is issued on the payment date.

§ 5. Client materials and content of the posts

  • The client provides only materials (photos, videos, texts, music, logos) they have the rights to and obtains the consent of people who can be seen or heard in them. The client is responsible for the lawfulness of the materials provided.
  • The client is responsible for the accuracy of the information about their business that they provide or approve: prices, terms of offers and promotions, interest rates, property descriptions, job offers, services and their results. The provider does not verify this information.
  • If advertising of the client's business is subject to special rules (for example loans and financial services, medical and health services, employment agencies, real estate), the client provides the information required in such advertising (for example the APR or a registration number) and checks that the Reel complies with these rules. The provider does not give legal, financial or medical advice.
  • Elements the provider adds to a Reel itself (stock footage, music, graphics, AI-generated images and characters, including in animated films) come from sources the provider is allowed to use, and generated characters do not depict real people without their consent. The provider is responsible for these elements.
  • The provider writes scripts, texts and hashtags based on information from the client. The client reviews each Reel before it is posted: by approving it, or by asking for Reels to be delivered to their post scheduling service without approving each one separately, the client adopts their content as their own message. The client may ask at any time for a Reel to be paused, corrected or removed from the posting queue.
  • By ordering a Reel with their own digital double (avatar, voice clone) or an animated film with a character based on their photo, the client agrees to the use of their appearance and voice for this purpose and may withdraw at any time. The provider creates a digital double of anyone else only with that person's consent (§ 13). Reels with a digital double or with realistic AI-generated images are labelled as required by the platforms and by the rules on artificial intelligence; the client does not remove these labels.
  • The provider may refuse to make a Reel whose content is unlawful, infringes personal rights or the rights of others, is misleading or incites hatred. The provider tells the client and offers another version.

§ 6. Rights to the materials

Once a billing period is paid, the client may use the Reels made in that period without limits of time or territory, for the needs of their business. Characters of animated films invented for the client are used by the provider only in materials for that client and as examples of its work.

By ordering the services (a subscription or a one-time order), the client agrees that the provider may publish the finished Reels and other materials made for the client, together with a description of the cooperation (what the client provided and what came of it, with the client's name or business name), as examples of its work and in advertising of its services: on the bevisible.social website and on its accounts on Threads, Instagram, Facebook, TikTok, YouTube, LinkedIn, X and Telegram, as well as on other social networks. This consent covers the dissemination of the client's image and voice seen or heard in these materials. The image and voice of other people are shown by the provider to the extent of the consent the client obtained from them (§ 5). The client may at any time ask for a specific example to be removed by writing to [email protected]: the provider removes it from the website and its accounts within 7 days and does not publish it again.

§ 7. Duration and cancellation

The subscription is monthly and does not require an annual contract. The client may cancel at any time; cancellation takes effect from the next billing period, with no extra charges.

§ 8. Liability

The provider is responsible for making Reels as agreed and makes changes the client asks for in ordinary correspondence. The provider does not guarantee a specific number of views, followers or sales, as these depend on platform algorithms and the client's niche.

Turnaround guarantee: if the client sends the material for a Reel on a working day (Monday to Friday, except public holidays in Poland) by 12:00 Warsaw time and the finished Reel (the first version, before any later revisions) is not delivered by the end of that same day, the provider extends the client's subscription by 7 days free of charge. The extension is made when the client asks for it in ordinary correspondence, separately for each such day.

  • The client posts the Reels on their own accounts (§ 3), so towards viewers and other people the client is responsible for the content posted, in particular for the materials and information they provided or approved (§ 5). The provider is responsible for the elements it added itself.
  • If anyone brings a claim against the provider concerning materials or information the client is responsible for, the client indemnifies the provider and reimburses its reasonable costs, including damages awarded and legal fees. The provider informs the client of the claim without delay and does not admit it without the client's consent. If the claim concerns an element added by the provider, the provider remakes the Reel without that element free of charge.
  • Anyone who believes a Reel infringes their rights can write to [email protected]. Within one working day the provider stops further delivery of that Reel and informs the client. A Reel that has already been posted is removed from the client's accounts by the client.
  • The provider's total liability to the client is limited to the amount the client paid for the billing period in which the damage occurred and does not cover lost profits. This limit does not apply to damage caused intentionally or to the clients referred to in § 10.
  • The provider is not responsible for platform decisions about the client's accounts and posts (reduced reach, content removal, account suspension) unless they are caused by an element added by the provider.

§ 9. Complaints

Complaints can be sent to [email protected] or via Telegram. We reply within 14 days.

§ 10. Consumers

If the client is a consumer, or a natural person entering into a contract directly related to their business that is not of a professional nature for them, they have the right to withdraw from a distance contract within 14 days. If the client asked for the service to start before this period ends, they pay for what was provided up to the moment of withdrawal. Once the service has been fully performed with the client's express consent, the right of withdrawal expires. A consumer may use out-of-court complaint procedures, for example the help of a municipal consumer ombudsman in Poland.

To withdraw, it is enough to send a statement to [email protected] or by post to the provider's address before the period ends. You may use the model below, but you do not have to.

§ 11. Personal data

How personal data is processed is described in the Privacy policy.

§ 12. Final provisions

Matters not covered by these terms are governed by Polish law. The terms may change; changes do not apply to a billing period that has already been paid.

These terms are available on this page before the contract is concluded and can be saved or printed. The contract is concluded when the client starts a subscription or makes a payment; by starting a subscription or paying, the client accepts these terms. The provider informs clients of changes to the terms by email or Telegram at least 14 days before they take effect; a client who does not agree may cancel the subscription before that date.

§ 13. Processing of personal data on the client's behalf

  • If materials provided by the client contain personal data of other people (image, voice, name and other information about the client's customers, staff or partners), the client, as controller, entrusts their processing to the provider, and this paragraph is a data processing agreement within the meaning of Art. 28 GDPR.
  • The provider processes this data only to perform the service, for the duration of the contract and only on the client's documented instructions; an order for a Reel and arrangements in correspondence are such instructions.
  • The provider keeps the data confidential, applies the security measures described on the «Security» page and assists the client in fulfilling the rights of data subjects and the obligations under Art. 32-36 GDPR.
  • The client gives general authorisation for the provider to use the sub-processors listed in point 5 of the Privacy policy. The provider announces any addition or replacement of a sub-processor by updating the Privacy policy, and the client may object.
  • The provider notifies the client of a breach of the entrusted data without undue delay, no later than 48 hours after becoming aware of it.
  • After the cooperation ends, the provider deletes the entrusted data within 6 months at the latest, or returns it earlier at the client's request, unless the law requires further storage.
  • The provider makes available to the client the information needed to demonstrate compliance with these obligations and allows it to be checked.
  • The provider makes a digital double of a person other than the client (appearance and voice) only after the client has passed on that person's written or electronic consent.
